Terms of Service

1. About these terms

We may present an updated version of these Terms for your acceptance from time to time — see Section 16.

2. Eligibility and age

• You must be at least 13 years old to use the Service.
• If you are 13 to 15 years old, or younger than the age of digital consent where you live (16 in Romania), you may only use the Service with the permission and supervision of a parent or legal guardian, who must read and agree to these Terms on your behalf. By using the Service you confirm that this permission has been given.
• You must not use the Service if you are barred from doing so under the laws of your country of residence, or if your account has previously been suspended or terminated by us.

3. Your account

• You sign in with Google Sign-In, with Sign in with Apple in the iOS app, or with a code we send to your email address. You are responsible for keeping your Google or Apple account, or your email account, secure; anyone with access to it can access your Preddify account.
• One account per person. Do not create an account for anyone else or on behalf of a group, and do not share your account.
• You are responsible for all activity that takes place through your account.
• The information provided through Google Sign-In, Sign in with Apple or Continue with email must be accurate, and you must keep your profile information up to date.
• Tell us promptly at hello@preddify.com if you believe your account has been compromised.

4. What Preddify is — and what it is not

Preddify is a prediction game for entertainment. You predict the scorelines of real football fixtures, join private leagues with friends, and compare results on leaderboards.

Preddify is not gambling: no money and no prizes can be won, and nothing in it has any value outside the game.

• There is no entry fee, stake, wager, or buy-in of any kind, and there never will be within this version of the Service.
• "Points", "snipes", league positions, rankings, and any other in-game status have no monetary value, cannot be purchased, sold, transferred, redeemed, or exchanged for money, goods, or prizes, and confer no rights outside the game.
• The "Sniper" mechanic is a head-to-head prediction contest between two players’ predictions of the same match. It is not a bet, a wager, or a stake on any outcome, and it must not be described as such.
• We do not offer, promote, or facilitate real-money gaming, betting, or gambling, and you must not use the Service to organise or settle any such activity between players.

The Service currently contains no in-app purchases, subscriptions, or paid features. If we ever introduce optional paid features, we will update these Terms and make the pricing and terms clear before you buy anything.

5. Acceptable use

When using the Service, you agree that you will not:

• break any applicable law, or infringe anyone’s rights (including intellectual property or privacy rights);
• choose a display name or league name that is unlawful, hateful, harassing, obscene, deceptive, impersonates another person or organisation, or infringes a trademark or other right;
• harass, abuse, threaten, or harm another player;
• cheat or manipulate the game — including using bots, scripts, automation, or multiple accounts to gain an advantage, or exploiting bugs instead of reporting them;
• access the Service by any automated means, scrape it, or place unreasonable load on our infrastructure;
• probe, scan, or test the vulnerability of the Service, or breach or circumvent any security or authentication measure;
• reverse engineer, decompile, or disassemble any part of the Service except to the extent that applicable law expressly permits;
• copy, modify, distribute, sell, or lease any part of the Service, or remove or obscure any proprietary notices; or
• use the Service in a way that could disable, overburden, or impair it, or interfere with any other party’s use.

We may investigate suspected breaches and cooperate with law-enforcement authorities where appropriate.

6. Your content

"Your Content" means the limited material you submit through the Service — currently your display name and the names of leagues you create.

• You keep any rights you have in Your Content.
• You grant us a worldwide, non-exclusive, royalty-free licence to store, display, and distribute Your Content solely to operate and provide the Service (for example, showing your display name to other members of your leagues). This licence ends when Your Content is deleted from the Service, except for copies retained in routine backups for a limited time, or where it has been shared with other players and forms part of a league’s history in a form that no longer identifies you.
• You are responsible for Your Content and confirm you have the right to submit it and that it does not breach Section 5.
• We may remove or change Your Content, or ask you to change it, if we reasonably believe it breaches these Terms or the rights of others.

7. The Service, football data, and scoring

• Football fixtures, kick-off times, results, and standings shown in the Service are obtained from third-party data sources and may be incomplete, delayed, or inaccurate. We do not guarantee their accuracy or timeliness.
• Predictions lock ahead of each fixture (by default one hour before kick-off; an administrator may set an earlier or later lock for a specific fixture). Once locked, a prediction cannot be created or changed.
• Points are calculated from the recorded result of each fixture. If a data source corrects a result, or if we identify a scoring error, we may recalculate points, snipes, and leaderboards, and the corrected values will stand.
• We may add, change, suspend, or remove features, game modes, competitions, or leagues at any time. We may run maintenance that makes the Service temporarily unavailable.
• We aim to keep the Service available but do not promise it will be uninterrupted or error-free.

8. Leagues

• Private leagues are created and managed by players. The player who creates a league acts as its administrator and can set its name, mode, competition, and scoring start, and can remove members.
• We are not responsible for how league administrators or other members behave, or for disputes between players about a league’s settings, membership, or results.
• We may remove a league or its content if we reasonably believe it breaches these Terms.

9. Intellectual property

• The Service — including its software, design, text, graphics, the "Preddify" name and logo, and its selection and arrangement of content — is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms, we grant you no rights in the Service.
• We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment, in line with these Terms.

Third-party names, marks, and logos. Club names, team names, competition names, and club crests or badges shown in the Service are the property of their respective owners and are used for identification purposes only. Preddify is independent and is not affiliated with, endorsed by, sponsored by, or associated with any football club, league, competition organiser, national association, federation, or governing body, or with any player, manager, or broadcaster. See the Acknowledgements notice for the full statement and attributions.

If you own rights in any material shown in the Service and believe it is used improperly, contact us at hello@preddify.com and we will address it promptly.

10. Feedback

If you send us ideas, suggestions, or feedback about the Service, you agree we may use them without restriction or obligation to you, and you grant us a perpetual, irrevocable, worldwide, royalty-free licence to do so. You are not obliged to send feedback.

11. Suspension and termination

• By you: you may stop using the Service at any time and may ask us to delete your account (see the Privacy Policy, Section 8).
• By us: we may suspend or terminate your access to the Service, or delete or restrict your account, if you breach these Terms, if we are required to by law, or if we reasonably believe it is necessary to protect the Service or other users. Where practical and lawful we will give you notice and, for less-serious issues, a chance to put things right.
• We may also discontinue the Service as a whole, with reasonable prior notice where practical.
• Sections that by their nature should survive termination (including Sections 6, 9, 10, 12, 13, 14, and 15) will continue to apply.

12. Disclaimers

To the fullest extent permitted by law, and except for warranties that cannot be excluded under mandatory law (including mandatory consumer-protection rights in Romania and the EU):

• the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• we do not warrant that the Service will meet your requirements, be available, uninterrupted, secure, or error-free, or that football data or scoring will be accurate or timely.

Nothing in these Terms limits your mandatory legal rights as a consumer.

13. Limitation of liability

To the fullest extent permitted by law, and subject to Section 12’s preservation of mandatory rights:

• we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or relating to your use of, or inability to use, the Service;
• our total aggregate liability arising out of or relating to the Service or these Terms will not exceed EUR 50 (or its equivalent), or the amount you paid us for the Service in the 12 months before the claim, whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under applicable law.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, losses, and reasonable expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or Your Content. This does not apply to the extent a claim results from our own breach or negligence.

15. Governing law and disputes

• These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of Romania, without regard to conflict-of-law rules.
• The courts of Romania have jurisdiction, except that if you are a consumer resident in the EU, you may also bring proceedings in the courts of your country of residence, and mandatory consumer-protection law of that country continues to apply to you.
• If you are an EU consumer, the European Commission’s Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged to participate in ODR but will consider it in good faith.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date and post the new version in the app and on the website. If a change is material, we will give you prominent notice and ask you to review and accept the updated Terms before you continue to use the Service. If you do not accept, you must stop using the Service and may delete your account.

17. General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service and replace any prior agreement.
• Severability. If any provision is found unenforceable, the rest remain in force.
• No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our consent. We may assign them to a successor in connection with a merger, acquisition, or sale of assets, on notice to you.
• No third-party rights. No one other than you and us has any right to enforce these Terms.
